These Terms of Service (“Terms”) govern your access to and use of the Monitoring & Evaluation App (“App”), operated by Elementary & Secondary Education Department (“we”, “us”, or “our”).
By downloading, accessing, or using the App, you agree to comply with these Terms. If you do not agree with these Terms, you should not use the App.
1. Purpose of the App
The Monitoring & Evaluation App is intended to support authorized monitoring, inspection, evaluation, reporting, data collection, and related administrative activities of Elementary & Secondary Education Department.
The App may allow authorized users to record, submit, review, or synchronize information relating to monitoring and evaluation activities, including information concerning institutions, facilities, projects, programs, visits, observations, and other official activities.
2. Eligibility and Authorized Use
The App is intended primarily for authorized officers, employees, representatives, or other persons permitted by Elementary & Secondary Education Department.
You may use the App only:
- for lawful and authorized official purposes;
- using an account assigned or approved for your use;
- in accordance with applicable departmental rules, policies, procedures, and instructions; and
- in compliance with applicable laws and regulations.
You must not allow another person to use your account or credentials unless expressly authorized.
3. User Accounts and Security
Certain features of the App may require you to sign in using an authorized account.
You are responsible for:
- keeping your username, password, PIN, or other authentication credentials confidential;
- protecting the device through which you access the App;
- ensuring that information submitted using your account is accurate to the best of your knowledge; and
- immediately reporting suspected unauthorized access, loss of credentials, or misuse of your account.
We reserve the right to suspend or disable an account where unauthorized, fraudulent, abusive, or inappropriate activity is suspected.
4. Information Submitted Through the App
Users may submit information through the App as part of official monitoring and evaluation activities.
Depending on the functions enabled by the organization, submitted information may include:
- monitoring or inspection details;
- institutional or facility information;
- observations and findings;
- dates and times of visits;
- photographs, documents, or supporting evidence;
- location information;
- responses to monitoring forms or questionnaires;
- comments, recommendations, and follow-up information; and
- other information required for official reporting purposes.
You are responsible for ensuring that information you submit is complete, relevant, and accurate to the extent reasonably possible.
You must not intentionally submit false, misleading, fabricated, unlawful, defamatory, or unauthorized information.
5. Location Services
Where location-based functionality is enabled, the App may request access to your device’s location for legitimate monitoring and evaluation purposes, such as verifying the location of an official visit or recording the location at which information is submitted.
Location information will be handled in accordance with our Privacy Policy and applicable organizational policies.
You may be required to enable location permissions for certain App functions to operate correctly.
6. Camera, Photos, and Documents
The App may request access to your device’s camera, photo library, or files where these permissions are required to capture or upload evidence, photographs, documents, or other materials associated with monitoring and evaluation activities.
You should upload only material relevant to the official purpose for which the App is being used.
You must not use the App to capture or upload content that violates applicable law, departmental policy, confidentiality requirements, or the rights of another person.
7. Offline Data and Synchronization
Some features of the App may permit information to be temporarily stored on your device when an internet connection is unavailable.
When connectivity becomes available, locally stored information may be synchronized with our systems.
Users should take reasonable precautions to protect devices containing unsynchronized official information. We cannot guarantee that locally stored or pending information will always be recoverable in the event of device loss, corruption, application removal, or technical failure.
8. Acceptable Use
You agree not to:
- use the App for any unauthorized personal, commercial, illegal, or fraudulent purpose;
- attempt to gain unauthorized access to another user’s account or restricted system;
- interfere with, damage, disable, or disrupt the App, its servers, APIs, or related systems;
- attempt to reverse engineer, modify, decompile, or circumvent security controls except where expressly permitted by applicable law;
- introduce malware, malicious code, automated attacks, or other harmful material;
- manipulate monitoring records, timestamps, locations, reports, or other official information;
- impersonate another user or misrepresent your authority;
- access or disclose information beyond your authorized role; or
- use information obtained through the App in a manner inconsistent with its official purpose.
Violation of these requirements may result in suspension or termination of access and may also lead to administrative, disciplinary, civil, or criminal action where applicable.
9. Privacy and Data Protection
Your use of the App is also subject to our Privacy Policy, which explains how information may be collected, used, stored, shared, and protected.
Where personal information is processed through the App, it will be handled in accordance with applicable laws, regulations, governmental requirements, and organizational policies.
Users are responsible for maintaining the confidentiality of information accessed through the App and must not disclose protected or restricted information to unauthorized persons.
10. Ownership of Data
Unless otherwise provided by applicable law or policy, information, reports, monitoring records, official photographs, documents, and other material created or submitted through the App in the course of official duties may be treated as official records of Elementary & Secondary Education Department.
Users do not acquire ownership rights over departmental or organizational data merely by accessing, creating, or submitting it through the App.
11. Intellectual Property
The App, including its software, design, interface, logos, graphics, databases, documentation, and other associated materials, is owned by or licensed to Elementary & Secondary Education Department and is protected by applicable intellectual property laws.
Except as expressly permitted, you may not copy, distribute, sell, sublicense, modify, reproduce, or commercially exploit any part of the App.
12. Availability and Changes to the App
We aim to maintain the availability and reliability of the App but do not guarantee uninterrupted or error-free operation.
The App may occasionally be unavailable due to:
- maintenance;
- upgrades;
- network or server problems;
- security requirements;
- third-party service interruptions; or
- circumstances beyond our reasonable control.
We may modify, update, add, restrict, suspend, or discontinue any feature of the App when reasonably required.
13. Accuracy of Information
The App provides a platform for collecting and managing monitoring and evaluation information. The accuracy of information displayed in the App may depend on data submitted by users or received from other official systems.
Users should verify critical information where necessary before relying upon it for administrative, financial, legal, disciplinary, or policy decisions.
14. Third-Party Services
The App may use or interact with third-party services, including services related to maps, notifications, authentication, hosting, analytics, or other technical functionality.
Such third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services except to the extent required by applicable law.
15. Suspension and Termination
We may suspend, restrict, or terminate your access to the App where:
- you are no longer authorized to use the App;
- your employment, assignment, or official role changes;
- your account presents a security risk;
- you violate these Terms or applicable policies;
- misuse or unauthorized activity is suspected; or
- suspension is necessary for administrative, legal, technical, or security reasons.
Upon termination of authorization, you must stop using the App and must not retain, copy, or disclose official information except where expressly authorized.
16. Disclaimer
The App is provided to support official monitoring and evaluation processes.
To the extent permitted by applicable law, the App is provided on an “as available” basis. We do not guarantee that every function will always operate without interruption, delay, technical error, loss of connectivity, or other limitations.
Nothing in the App should be interpreted as replacing any official approval, notification, order, rule, procedure, or legally required decision-making process unless specifically authorized by Elementary & Secondary Education Department.
17. Limitation of Liability
To the extent permitted by applicable law, Elementary & Secondary Education Department, its officers, employees, contractors, or service providers will not be liable for indirect, incidental, consequential, or special loss arising from:
- temporary unavailability of the App;
- loss of network connectivity;
- device malfunction;
- unauthorized use resulting from failure to protect account credentials;
- inaccurate information submitted by users; or
- circumstances beyond our reasonable control.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
18. Compliance With Official Rules
Where you are using the App in an official capacity, your use remains subject to applicable:
- service rules;
- departmental policies;
- confidentiality obligations;
- information security policies;
- monitoring and inspection procedures;
- records-management requirements; and
- directions issued by competent authorities.
If there is a conflict between these Terms and a binding law, regulation, government order, or official departmental instruction, the applicable legal or official requirement will prevail.
19. Apple App Store Terms
If you download the App through the Apple App Store, you acknowledge that these Terms are between you and Elementary & Secondary Education Department, and not Apple Inc.
Apple is not responsible for the App or its content, maintenance, support, or operation except as required under the applicable App Store terms.
Your use of the App must also comply with the applicable Apple Media Services Terms and App Store rules.
20. Changes to These Terms
We may revise these Terms periodically to reflect changes in the App, organizational requirements, applicable laws, security practices, or operational procedures.
The updated Terms will be made available through the App or another appropriate channel, along with an updated “Last Updated” date.
Continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms where permitted by applicable law.
21. Governing Law
These Terms shall be governed by and interpreted in accordance with the applicable laws of Pakistan and any other laws, rules, regulations, or governmental requirements applicable to Elementary & Secondary Education Department.
Any dispute relating to the App shall be handled by the competent authority or court having jurisdiction in accordance with applicable law.
